This is an appeal from an order denying the motion of the defendant Fidelity & Casualty Company of New York for summary judgment dismissing the complaint against it. The suit was commenced by the plaintiff Harvey L. Zimmer to recover damages for injuries he received when he was struck by a bucket on a crane operated by the defendant Robert Dean. Zimmer, Dean, and the defendant Roger Daun, were employees of Hedrich Construction Company (Hedrich) which was building an incinerator plant in Sheboygan, Wisconsin. Hedrich had ordered ready-mixed concrete from Van Der Vaart Brick & Building Supply Company, which was insured by the defendant Fidelity & Casualty Company of New York (Fidelity).
